FAA Part 107 Requirements

All commercial drone operations in New York require the pilot to hold an active FAA Part 107 Remote Pilot Certificate. Our network operators are verified Part 107 holders.

State Drone Laws

New York regulates drone operations through a combination of criminal surveillance statutes, state park rules, and local ordinances. New York Penal Law 250.55 (amended 2023) classifies unlawful surveillance conducted via unmanned aerial vehicle as a Class E felony, prohibiting the use of drones to capture images of individuals in private settings without consent. The New York State Office of Parks, Recreation and Historic Preservation requires a commercial use permit under 9 NYCRR 375.1 for drone operations in all state parks and historic sites. New York does not require a separate state-level commercial drone license or registration, but all commercial operators must hold a valid FAA Part 107 Remote Pilot Certificate and register their aircraft with the FAA. New York City has additional local restrictions — Local Law 152 of 2024 requires permits for commercial drone filming on city property and within certain NYC parks. Westchester County parks require a permit from the Westchester County Parks Department. The state does not broadly preempt local municipalities, meaning individual cities and towns may enact their own drone ordinances governing takeoff, landing, and operation on public property. Commercial operators near military installations (West Point Military Reservation, Watervliet Arsenal, Stewart Air National Guard Base) must coordinate with base operations and check NOTAMs. The FAA controls all airspace above 400 feet AGL and LAANC authorization is available for Class B and C airspace across the NYC metro region.

Local Ordinances

Saratoga Springs is governed by New York state drone law (NY Penal Law 250.55 — unlawful surveillance via drone is a Class E felony) and FAA Part 107 regulations. The City of Saratoga Springs does not have a specific municipal drone ordinance beyond state law, but commercial drone takeoff and landing on city property requires authorization from the Saratoga Springs Department of Public Works. Saratoga Spa State Park, a National Historic Landmark adjacent to downtown, requires a commercial drone permit from the NYS Office of Parks, Recreation and Historic Preservation under 9 NYCRR 375.1 — unauthorized flights are actively enforced by park police. Saratoga National Historical Park (Battlefield) prohibits all drone operations under 36 CFR 1.5. During the Saratoga summer racing meet (mid-July through Labor Day), the FAA issues TFRs within 1 NM of Saratoga Race Course — commercial operators must check NOTAMs before every flight. The Skidmore College campus restricts drone operations on or above college property to college-affiliated research with prior approval. Commercial drone filming for movies, TV, or advertising requires a film permit from the Saratoga Convention and Tourism Bureau. FAA Part 107 Remote Pilot Certification is required for all commercial operations. LAANC authorization is required for flights within the ALB Class C airspace boundary in southern Saratoga County.

Restricted Airspace

• Saratoga Race Course hosts the Saratoga summer racing meet (mid-July through Labor Day). The FAA and NYRA routinely issue Temporary Flight Restrictions (TFRs) prohibiting UAS operations within 1 NM of the racetrack during race days. NOTAMs are issued via KZBW (Boston Center). Commercial drone operators must check active TFRs before every flight during racing season — this is the single most important airspace consideration for Saratoga Springs.
• Albany International Airport (ALB) Class C airspace has a 5 NM radius surface area and outer shelf extending to 10 NM. The southern edge of the ALB Class C outer shelf reaches into southern Saratoga County. Commercial drone operations within the ALB Class C lateral boundaries require LAANC authorization. Most of Saratoga Springs proper is outside the Class C surface area but operators in southern Saratoga County (near Round Lake and Malta) should check the Class C shelf boundaries.
• GlobalFoundries semiconductor fabrication plant in Malta (8 NM south of Saratoga Springs) is a major industrial facility with security considerations. While there is no restricted airspace directly over the fab, the facility has high-security fencing, surveillance, and sensitive proprietary operations. Commercial drone operators should coordinate with GlobalFoundries security before flying near the Malta campus. The site is near the ALB Class C outer shelf.
• Saratoga National Historical Park (Battlefield) is a National Park Service site approximately 4 NM southeast of Saratoga Springs. The National Park Service prohibits drone operations within park boundaries under 36 CFR 1.5 and 36 CFR 36.3. Commercial operators must not launch, land, or operate drones within the park boundary. The park encompasses the Saratoga Battlefield, Schuyler House, and Saratoga Monument.
• Saratoga Spa State Park, located directly south of downtown Saratoga Springs, is a National Historic Landmark and New York State Park. Drone operations require a permit from the NYS Office of Parks, Recreation and Historic Preservation under 9 NYCRR 375.1. The park contains the Saratoga Performing Arts Center (SPAC), the National Museum of Racing, mineral springs, golf courses, and historic bathhouses. Unauthorized drone flights in the park are prohibited and actively enforced by park police.
